Who processes your data ?

The controller responsible for collecting and processing your personal data is FELCO SA, Rue des Mélèzes 4, CH-2206 Les Geneveys-sur-Coffrane (hereinafter “FELCO” or “we”).

What data do we collect ?

  • Data you provide to us : Name, surname, postal address, email address, telephone number, language preference and country of origin when you purchase a FELCO product, directly request after-sales services, invoke a legal or commercial warranty or register your power tool, communicate with us, subscribe to our newsletters, or request information.
  • Data provided by our subsidiaries, importers and independent repairers : Our subsidiaries, importers and independent repairers share your data with us when you request after-sales services or invoke a legal or commercial warranty and our expertise is required to handle your request. 
  • Data collected automatically : IP addresses, your computer name and browser information through cookies when you browse our websites.

Why do we process your data ?

  • Performance of contracts : To process your orders and deliver products purchased on our online sales sites, and to respond to your after-sales service requests, including those relating to legal or commercial warranties.
  • Communications based on your consent : To send you our newsletters, allow you to take part in one of our contests, interact with our content on social media and in marketing communications.
  • Legitimate interest : To improve the quality of our websites and products, enhance your browsing experience, ensure security, and promote our tools and services.
  • Legal obligations : To comply with the legal and regulatory requirements applicable to us, such as accounting obligations.

    However, we strongly encourage you to contact us first so that we can review and address your request efficiently and promptly.

This second section explains which data we collect and process for each service, the purposes of this processing and the retention period for this data.

Browsing on FELCO websites

When you browse our websites, we automatically collect certain technical information such as your IP address and browser information through temporary and permanent cookies.
This data is processed based on our legitimate interest in analysing and improving our websites, monitoring their quality, ensuring their security and protecting our rights and those of our users.

Online purchases and contractual relationship

When you purchase a product on our online sales websites, we collect the personal and contact details necessary to perform the contract, including your name, surname, company name, delivery and billing postal addresses, and email address.
This data is processed for the performance of the sales contract according to the subsidiary of the group with whom you conclude the contract:

Your personal data is retained for three years from your last interaction with our services. After this period, it is transferred to our archives, where it is kept in accordance with our legal and regulatory obligations.

We do not collect or store your credit card information. These details are processed exclusively by external electronic payment service providers.

For sales in the European Union and the United Kingdom, we may transmit your personal data to our local importers for managing your orders, deliveries and customer service. These transfers ensure optimal handling, particularly in the event of delivery issues or after-sales service requests.

Marketing communications

Newsletters : When you subscribe to our newsletters, we collect your email address and, where applicable, other information such as your name, surname, company name, language preference and country of origin that you voluntarily provide. This data is processed based on your consent. Your data is retained until you unsubscribe, which you may do at any time using the link included in each newsletter.

Contests : When you participate in one of our contests, we collect your email address and, where applicable, other information such as your name, surname, company name, language preference and country of origin through the registration form. This data is used solely for organising and managing the contest. We retain this data for three months after the contest ends.

Social networks and cookies : External partners such as Google or Meta may place cookies on our websites. You may refuse these third-party cookies through the consent settings in the cookie management panel. Social networks (Facebook, X, Instagram, LinkedIn, Pinterest, YouTube) may also place cookies via their integrated sharing buttons. Workshops and restoration services

During workshops and restoration services, we collect the identification and contact details necessary to perform the restoration contract, including your name, surname, company name, delivery and billing postal addresses, and email address. Your personal data is retained for three years from your last interaction with our services. After this period, it is transferred to our archives, where it is kept in accordance with our legal and regulatory obligations.

MyFelco smartphone application

When you register for the MyFelco app, we collect your identification and contact details: name, surname, company name, postal addresses and email address. eSAV after-sales service platform for power tools

When our resellers use the eSAV platform, they transmit your identification and contact details to us: name, surname, company name, postal addresses and email address. This data is required to process your after-sales service request relating to your power tool. Only your distributor in your country and our after-sales service team have access to this data. Your personal data is retained for three years from your last interaction with our services. After this period, it is transferred to our archives, where it is kept in accordance with our legal and regulatory obligations.

B2B ordering platform

When our resellers use our online B2B ordering platform, they may provide us with the data of their staff (employees or managers): name, surname, company name, postal addresses and email address. This information is required to verify the identity of individuals authorised to place orders on behalf of the reseller and to process their orders. Access to this data is restricted to your employer and our commercial services. We retain this data for as long as the reseller keeps the account active. To delete or modify your personal data, please contact the reseller to whom this data is linked in our system. Communications and information requests

When you contact us by email or other means to request information, we process the personal data you voluntarily provide based on your consent. This data is stored according to the type of your request and the time required to respond and process it.

Processing for another compatible purpose

We may process data collected for other purposes compatible with those mentioned above, such as for statistical analysis regarding tool usage, or to inform you of safety concerns or potential product defects, in accordance with our legal obligations.

Technical and legal information

This third section provides more technical and legal information, such as the specific legal bases depending on the jurisdictions, the relationships with other companies that process your data as part of our activities, where your data is stored and any transfers to other jurisdictions, as well as the organisational and security measures implemented.

Legal bases in the EU and the EEA

The processing of your personal data when you visit our websites is based on our legitimate interest linked to the conduct of our activities in accordance with Article 6(1)(f) of the GDPR. The processing carried out when you subscribe to newsletters or submit information requests is based on your consent according to Article 6(1)(a) of the GDPR. Communications within the framework of a contractual relationship are based on the preparation or performance of a contract in accordance with Article 6(1)(b) of the GDPR, and, depending on the circumstances, on our legitimate interest or on our legal obligations.

FELCO collects personal data when a product is purchased through the online sales websites. This data is transferred to and stored by FELCO Europe GmbH on servers located in Germany and is processed by the latter to carry out purchase orders, product deliveries, return and warranty requests, as well as other services related to the performance of the sales contract.

Retention periods

Data collected when subscribing to newsletters is retained until you unsubscribe. Data transmitted by email or post is stored according to the nature of your request. For contractual relationships, personal data is retained for thirty-six months after each product order, or for the duration of the longest manufacturer’s warranty offered by FELCO, or for the time necessary to process your claims or specific requests. The data is then kept in archives for the applicable statutory limitation periods, which may be up to ten years from the date of the last purchase of FELCO products, or to fulfil our legal obligations, such as product safety notifications or product recalls. We may also retain data to establish, exercise or defend our legal rights or for archiving or historical purposes, anonymising the data where possible.

Third-party providers and processors

Third-party service providers that support FELCO may have access to certain personal data. These third parties mainly assist us with IT system maintenance and support, database management, e-commerce services, logistics and deliveries, or marketing communications such as the distribution of our newsletter.

Our processors store personal data on servers located in Switzerland, in the European Union, or in a country recognised as providing an adequate level of protection by the EU and Switzerland. Our US-based service providers participate in the Data Privacy Framework programme recognised as adequate by the EU and Switzerland.

International transfers

FELCO’s databases are hosted in Switzerland, while those of FELCO Europe GmbH are hosted in Switzerland and in the European Union. Switzerland has been recognised by the European Union as a country offering an adequate level of protection and is a signatory to Council of Europe Convention 108 for the Protection of Individuals with regard to Automatic Processing of Personal Data.

Personal data of users and purchasers is generally not transferred to countries other than Switzerland, the European Union or your country of residence, as transfers mainly occur between your country of residence and Switzerland or the European Union, and vice-versa. Our US-based IT solution providers participate in the Data Privacy Framework programme recognised as adequate by the EU and Switzerland.

No sale or sharing with third parties

Neither FELCO nor PYGAR USA sells or shares your personal data with third parties within the meaning of Californian law (CCPA and CPRA). Therefore, no specific tool or link enabling you to object to the sale or sharing of your personal data is provided.

We use social media services. However, neither FELCO nor PYGAR USA transmits personal data collected during your purchases on our website or during your interactions with us to social media platforms or to other third-party providers.

Security measures

When using our websites, data, including personal data, is transmitted in encrypted form using SSL. We use encryption, anonymisation and pseudonymisation where appropriate. We monitor our systems to detect potential vulnerabilities and attacks in order to protect your personal data from unauthorised access, alteration, disclosure or destruction.

Data sharing required by law

FELCO may be required to disclose and transfer your personal data if required by applicable law, or to comply with legal proceedings, court orders, other legal obligations, or investigations conducted by public or judicial authorities. Such disclosure may also occur to protect and defend the rights, property or safety of FELCO, its websites, its customers or its users.

Local content and country-specific pages

FELCO has authorised its subsidiaries to manage the information contained in pages specific to their respective countries. If one of the websites or pages containing local content includes specific data protection conditions, those conditions will prevail over this policy.

Changes and language versions

This privacy policy may be amended at any time. In the event of discrepancies between the French version and a version in another language, the French version shall prevail.
